Vicarious liability
Vicarious liability
Real World
In Lister v Hesley Hall Ltd [2001], a boarding school was held vicariously liable for a warden's sexual abuse of pupils because his role gave him the opportunity to commit the tort — the close connection between his duties and the abuse made the school liable despite never authorising it.
Exam Focus
Always identify both elements: an employment relationship AND the tort committed in the course of employment, or you will lose marks.
