Occupiers Liability Act 1984
Occupiers Liability Act 1984
Real World
In Tomlinson v Congleton Borough Council [2003], a man who dived into a lake on council land and became paralysed sued the council; the House of Lords found the 1984 Act did not impose liability because the risk was obvious to an adult trespasser.
