By 1949, Germany lay physically ruined, politically divided between Allied occupiers, and socially traumatised by twelve years of Nazi rule and total war. Two separate German states formally came into existence that year.

The Federal Republic of Germany (West Germany) formally came into existence on 23 May 1949 with a new constitution — the Basic Law — deliberately designed to prevent another Nazi seizure of power, including a constitutional court empowered to ban anti-democratic parties.
